Restraining Orders


A restraining order is a court order issued upon application by one party that forbids another party from doing something.  In most cases, restraining orders are issued to protect victims of abuse and/or domestic violence. A restraining order can protect the victim from further harm and will prohibit the other party from being in the presence of the victim.  If a person feels threatened by another individual, or is concerned about his/her physical safety, he/she should consult with an attorney with prior restraining order experience.  An attorney can evaluate the person’s individual situation and help the person obtain a restraining order in an efficient and timely matter.  

Types of Restraining Orders
There are several different types of restraining orders that a person may apply for:

  • Civil Harassment Restraining Order – a civil order that prevents future harassment from people such as neighbors, co-workers, or people that the applicant may be acquaintances with.

  • Domestic Violence Protective Restraining Order – a temporary restraining order that protects victims of domestic violence for 3 weeks up to 3 years.

  • Criminal Protective Order – an order that is issued for active domestic violence cases, and is issued by a California District Attorney.

  • Emergency Protective Order – an order issued by California law enforcement that is legally valid for up to 5 days.

Once a restraining order has been filed, the respondent (person the order was issued against) must stop harassing, contacting, and/or abusing the petitioner (person who applied for the restraining order).  If the respondent violates the terms of the restraining order, he/she may be subject to further legal action by California law enforcement.
